Giveaway Rules

1) Eligibility: The Douglass Nissan of Waco Giveaway (hereafter, “Promotion”) is open to persons who are eighteen (18) years of age or older, as of the date of entry, are physically located and residing in Texas at the time of the prize drawing. Officers, directors, members, employees, representatives and agents of Douglass Nissan of Waco (“Douglass Nissan”) and any of their respective parents, affiliates, subsidiaries, and their immediate family members (parent, spouse, child, or sibling, and their respective spouses), and those living in their same households, whether or not related, (collectively “Ineligible Participants”) are not eligible to enter or win a prize or be the recipient of any prize related to this Promotion. Void where prohibited or restricted by law.

2) AGREEMENT TO OFFICIAL RULES: Participation in the Promotion constitutes participant’s full and unconditional agreement to and acceptance of these rules and decisions of Douglass Nissan, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3) PROMOTION PERIOD: Promotion begins November 13, 2023, and ends at the time of drawing, which will be approximately 1:00 p.m. on November 18, 2023 (the “Promotion Period”). All entries submitted before or after the Promotion Period will not be eligible.

4) HOW TO ENTER: Eligible participants may enter the Promotion by test driving a new or used vehicle at Douglass Nissan and completing an entry form in person at the Douglass Nissan showroom located at 5605 Legend Lake Parkway, Waco Texas 76712. LIMIT TWO (2) COMPLETED ENTRIES PER HOUSEOLD FOR THE DURATION OF THE PROMOTION PERIOD. Entries received in excess of the stated limitation will be void. Incomplete entries will be void. All entries become property of the Douglass Nissan and will not be returned. By entering this Promotion, you agree to permit Douglass Nissan and its affiliates to use the information you provide for marketing and promotional purposes.

5) PRIZES: Three (3) prizes will be awarded in this Promotion: one 50” Vizio V-Series Television (valued at $250.00), one KitchenAid Tilt-Head Stand Mixer 5 quart in Pebbled Palm color (valued at $350.00), and one 64GB iPad Air 5th Generation with Wifi (valued at $500.00). Each prize is awarded as is.

6) PRIZE DRAWING: The winner for each prize of the Promotion will be selected in a random drawing conducted by Douglass Nissan at the end of the Promotion Period from among all the valid entries received during the Promotion Period. Participants need not be present at the random drawing to win. In the event a winner waives their right to receive his/her prize; Douglass Nissan reserves the right to award the prize to the next qualified and eligible entry. Each winner of a prize will be notified via their preferred contact method as indicated on the entry form. Prizes must be claimed within seventy-two (72) hours following the drawing at the Douglass Nissan showroom located at 5605 Legend Lake Parkway, Waco Texas. If a winner fails to claim his or her prize within such time, then another winner will be chosen in a random drawing from all eligible entries.

7) PUBLICITY: Participants and winners agree, by entering and accepting a prize (as applicable), that Douglass Nissan and its designees may use (unless prohibited by law), participants’ and winner’s names, cities and states of residence, photographs and/or likenesses for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification. Failure to make promotional appearances requested by Douglass Nissan or grant such rights as reasonably requested by Douglass Nissan may result in disqualification.

8) GENERAL CONDITIONS: Douglass Nissan reserves the right, in its sole discretion, to: a) disqualify any participant and void any entries of participants whom Douglass Nissan believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion or are in violation of these Official Rules; 2) modify, terminate or suspend this Promotion should non-authorized human intervention or other any causes corrupt or impair the administration, security, fairness or proper play of the Promotion, or for any other reason, as determined by Douglass Nissan in its sole discretion. In the event of termination of the Promotion, Douglass Nissan reserves the right to select the winners in a random drawing from among all eligible non-suspect entries received up to time of such action. The validity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The decisions of Douglass Nissan as to the interpretation of these rules and all other aspects of the Promotion shall be final and binding in all respects. Douglass Nissan is not responsible for typographical, printing, website or other inadvertent errors in these rules or in other materials relating to the Promotion.

9) DISPUTES/ARBITRATION: PARTICIPANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF, OR CONNECTED WITH, THE PROMOTION OR ANY PRIZE AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY RESOLVED BY BINDING ARBITRATION PURSUANT TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION OR AN ARBITRATION ASSOCIATION AS AGREED BETWEEN THE PARTIES AND WILL BE VENUED IN MCLENNAN COUNTY, TEXAS. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, your rights and obligations, or the rights and obligations of Douglass Nissan in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Texas, without giving effect to any choice of law or conflict of law rules (whether of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Texas.

10) RELEASE AND LIMITATIONS OF LIABILITY: Participants agree, by entering the Promotion that the Ineligible Participants shall have no liability and will be held harmless by participant for any claim, action, liability, loss, injury or damage to participant or any other person or entity, including, without limitation, personal injury or death to participant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Promotion. Each participant agrees: (1) to waive all rights to claim or collect punitive, incidental, consequential or any other damages; and (2) that all causes of action relating to this Promotion will be resolved individually without resort to any form of class action.

11) CONSUMER DISCLOSURE: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. You have not yet won. Odds of winning the prize is dependent on the total number of eligible entries received throughout the Promotion. Each entry will have an equal chance of winning. Void where prohibited. This Promotion is not valid with any other special offer or special program. Douglass Nissan reserves the right to change any or all portions of this Promotion without prior notice.
